THE FOLLOWING ARE THE TERMS ON WHICH ALBUQUERQUE FOREIGN AUTO PARTS INC. OFFERS YOU ACCESS TO OUR WEBSITE AND BY USING OUR WEBSITE YOU AGREE TO THESE TERMS.

This Agreement describes the terms and conditions that apply when you use our services and site. We may amend this Agreement at any time by posting the amended terms on our site. All amended terms will be effective as soon as they are posted on our site unless a different effective date is specified elsewhere in this Agreement, or in the amendment. This Agreement may not otherwise be amended. "We" and "Our" refer to Albuquerque Foreign Auto Parts Inc., its corporate owners and affiliated companies, and the officers, directors, and shareholders of Albuquerque Foreign Auto Parts Inc. its corporate owners and affiliated companies. "You" refers to the user of this site.

1. Our site and parts are available only to legal entities and to individuals who can form legally binding contracts under applicable law. In addition, you must be 18 years old or older to use the services on our site.

2. Currently, searching our inventory for parts is free. We retain the right to amend this provision and begin charging a fee for this service.
 

3. You agree that any information you send to us when using our website, by email or otherwise, will be true, correct, and comply with all applicable laws. In particular, you shall not send anything that a) is fraudulent, b) infringes any third party's contract, copyright, patent, trademark or trade secret rights, or other intellectual property rights, c) is defamatory, libelous or threatening or harassing, d) is obscene, or e) contains any viruses or other computer code that is intended to damage or disrupt any system or that intercepts or expropriates any data or information.

4. Our website contains content, information, and technologies that are proprietary. You agree not to copy, reproduce, alter, modify, re-publish, create derivative works, or publicly display any content from our website without the prior written permission of an authorized representative of Albuquerque Foreign Auto Parts Inc., Using our searchable database and reviewing our parts pricing to establish or maintain your pricing is not allowed as a use of this site , and will be considered a violation of this agreement.

5. This Site uses the Hollander Interchange.The Hollander Interchange is © 2007 ADP CSG, Inc. Albuquerque Foreign Auto Parts Inc., pays for the right to use the Hollander Interchange in our daily business. 
You agree not to use the Hollander Interchange for any purpose other than in connection with this Site and for the purposes for which this site is intended.
You further agree not to use this Site or the information provided to you through this Site for the purpose of copying all or any part of the Hollander Interchange or decompiling or reverse engineering the Hollander Interchange or in any way violating ADP CSG, Inc's copyright in the Hollander Interchange.

This agreement is between you and Albuquerque Foreign Auto Parts Inc. and shall be construed in accordance with and governed by the law of the State of New Mexico (without regard to principles of conflict of laws), including the application of any applicable statutes of limitations. Any action, suit or proceeding brought by any party with respect to, or to enforce the terms of, this agreement shall be brought by such party exclusively in the courts of the 2nd Judicial District of New Mexico in the County of Bernalillo, in the City of Albuquerque, New Mexico USA.

6. You agree to indemnify and hold us and our suppliers, subsidiaries, affiliates, officers, directors, agents and employees harmless from any claim and demand, including reasonable attorneys' fees, that arises out of your breach of this Agreement or your use of our site.

7. Any notices to Albuquerque Foreign Auto Parts Inc., must be given by postal mail sent to Albuquerque Foreign Auto Parts Inc. corporate offices as it is posted on our web site. Any notices to you will be sent to the e-mail address you provide to Albuquerque Foreign Auto Parts Inc.,

8. Albuquerque Foreign Auto Parts Inc., makes available our part inventory to several third parties for sale, therefore any part displayed on our site is subject to first come first serve basis. If you order a part and it is no longer available, we reserve the right  to obtain a like, kind and quality part to substitute for the order, or we reserve the right to cancel the order. In either case Albuquerque Foreign Auto Parts Inc., will notify you by email address provided to us, that such an event has taken place. 

9. Albuquerque Foreign Auto Parts Inc., HEREBY DISCLAIM ALL PARTS WARRANTIES, EXPRESS OR IMPLIED,  OF TITLE, MERCHANTABILITY AND FITNESS FOR ANY PARTICULAR PURPOSES WHATSOEVER. Some States do not allow the disclaimer of implied warranties, so the foregoing disclaimer may not apply to you. This warranty gives you specific legal rights and you may also have other legal rights, which vary from state to state.
